U.S. Court in Alabama Holds Hospital’s Knowledge of ER Patient’s Symptoms Did Not Trigger EMTALA Liability

An Alabama hospital was not liable under the Emergency Medical Treatment and Labor Act (EMTALA) for discharging a patient with unresolved symptoms—including dizziness, vomiting, and a severe headache—that may or may not have indicated an emergency medical condition, a federal district court held September 26.
