Academic Medical Center Financial Alignment: Legal Considerations Under the Anti-Kickback and Stark Laws

Mission support and other financial alignment strategies are critical tools for academic medical centers (AMCs) and can help them adapt to the financial, political, and operational challenges that they currently face. Federal regulators have recognized that the tripartite mission of AMCs frequently involves interrelated finances and have provided express regulatory guidance that supports financial arrangements that would likely be impermissible in other contexts. As they respond to current pressures and enter a new era of shifting enforcement and policy priorities, AMCs have additional flexibility to respond to challenges with integrated financial strategies. AMCs should refamiliarize themselves with the current legal guidance and its underpinnings, both to promote compliance as they make changes and to understand the degree of reliance that they can place on existing guidance in a dynamic regulatory environment.
