Iowa Supreme Court Says Hospital’s Vicarious Liability Concession Bars Negligent Retention Claim

A plaintiff could not maintain a negligent hiring and retention claim against a hospital where her husband died after it stipulated that an employed nurse was acting within the scope of her employment and conceded vicarious liability for any negligence found in the wife’s wrongful death action, the Iowa Supreme Court held May 22.
