U.S. Court in Massachusetts Says Peer Review Privilege Doesn’t Bar Disclosure in Health Care Fraud Action

A teaching hospital may not claim Massachusetts’ peer review privilege as the basis for refusing to produce documents sought by a relator in a whistleblower action under the False Claims Act alleging health care billing fraud, a federal district court in the state ruled October 28.
