Supreme Court Won’t Review Decision That Dismissal of Qui Tam Claims Didn’t Bar State from Filing Separate Action

The U.S. Supreme Court declined January 11 to review a New Mexico appeals court decision holding that the dismissal of a relator's qui tam action for failure to state a claim did not bar a state from subsequently pursuing a separate action under different statutes based on the same conduct.
