The U.S. District Court for the District of Columbia dismissed Vanda Pharmaceutical’s lawsuit alleging certain Food and Drug Administration (FDA) personnel lacked authority under the Appointments Clause to consider its New Drug Application (NDA), finding the company’s petition to the D.C. Circuit stripped the lower court of jurisdiction.
