A Centers for Medicare & Medicaid Services (CMS) rule requiring a Section 1135 waiver and a public health emergency declaration before allowing a star rating adjustment for Medicare Advantage (MA) plans in “extreme and uncontrollable circumstances” was not arbitrary and capricious, the U.S. District Court for the District of Columbia held May 16.
