The Second Circuit rejected February 24 a False Claims Act (FCA) whistleblower action alleging Siemens Healthcare Diagnostic, Inc. defrauded federal health care programs by submitting or causing the submission of claims for unreliable in vitro diagnostic devices (IVDs).
