CMS Proposes Paying $9 Billion to 340B Hospitals and Reducing Payments to All OPPS Hospitals to Remedy Unlawful 340B Payment Policy

On July 7, 2023, the Centers for Medicare & Medicaid Services (CMS) issued a proposed rule to remedy the Medicare payment policy for drugs acquired under the 340B drug pricing program (340B program) found unlawful by the U.S. Supreme Court. The proposed remedy is in response to a unanimous decision issued in June 2022 by the Supreme Court finding that CMS exceeded its authority when Medicare reduced payment rates for 340B hospitals under the 2018 Outpatient Prospective Payment System (OPPS) final rule. CMS is soliciting feedback on the proposed remedy and plans to issue a final rule later this year.
