Understanding Workplace Protections for Transgender Employees in 2025: Title VII, Bostock, and Beyond

Since the new administration took office, a plethora of activity has occurred on issues regarding transgender individuals. Recent executive orders have restricted diversity initiatives within federal agencies and have narrowly defined “sex,” prompting many employers to reconsider their approach to managing transgender employees. Despite these executive actions, federal law continues to provide protection from discrimination to transgender employees under Title VII of the Civil Rights Act of 1964 (Title VII). Additionally, some states, counties, and municipalities have enacted their own protections for these individuals in the workplace. This article is intended to provide an overview of the current state of the law affecting transgender employees.
