On November 8, 2022, the U.S. Supreme Court heard oral argument on whether recipients of federal assistance programs, such as Medicaid, should be permitted to sue states when they believe their rights have been violated. The outcome of the case could have substantial effects on recipients’ private enforcement of their right to a certain quality of care at Medicaid-funded facilities.
