Information Blocking—Updates to Access to Health Information

The compliance requirements of the new Information Blocking regulations, implemented by the U.S. Department of Health and Human Services (HHS) and set forth in the 21st Century Cures Act (Cures Act), went into effect on April 5, 2021. These regulations require (1) health care providers; (2) health IT developer(s) of certified health IT; and (3) health information network(s) or health information exchange(s) (collectively referred to as “actors”) to fulfil a patient’s request for Electronic Health Information (EHI) in a reasonable manner.
