The FTC’s 2023 Updated Endorsement Guides and the Life Sciences Industry Impact

On June 29, the Federal Trade Commission (FTC) released updated guidance clarifying and strengthening the agency’s current Endorsement Guides. These Endorsement Guides, last updated in 2009, aim to address industry and technology changes that impact the ways endorsements, promotions, and reviews reach customers. Over the last 14 years, the proliferation of social media in our personal and professional lives means it is now an essential component of any corporation’s marketing strategy. With increased social media utilization and increased digital marketing capabilities, the FTC drafted the updated Endorsement Guides to address concerns from corporations and marketing teams seeking to employ bold digital marketing strategies while avoiding what the FTC considers deceptive endorsement practices.
