Arizona Judge Says State’s 15-Week Abortion Ban Is Unconstitutional

An Arizona law prohibiting nearly all abortions after 15 weeks of pregnancy is unconstitutional, a state court judge ruled March 5 in issuing a permanent injunction barring the ban’s enforcement.
Planned Parenthood of Arizona and two physicians challenged the statute in Arizona Superior Court, Maricopa County, arguing it violated a voter-passed constitutional amendment enshrining a fundamental right to an abortion before fetal viability.
Before the ruling, Arizona Attorney General Kris Mayes already had agreed not to enforce the ban after voters passed the constitutional amendment in November 2024.
The court’s order permanently enjoins the state from “implementing, enforcing, or giving any effect to the provisions” of the challenged statute, which took effect after the Supreme Court issued its decision in Dobbs v. Jackson Women’s Health Organization, 597 U.S. 215, 292 (2022).
