Fourth Circuit Affirms Dismissal of Whistleblower Action Alleging Medicaid Rebate Program Fraud

The full Fourth Circuit upheld September 23 the dismissal of a qui tam action alleging that Forest Laboratories (Forest), a subsidiary of Allergan plc, violated the False Claims Act (FCA) by providing false price reports to the government under the Medicaid Drug Rebate Program, causing overpayments for the company’s drugs.
