Medicare Advantage Plans and the Two-Midnight Rule: A Deep Dive into Plan Requirements

The Traditional Medicare program has been undergoing an evolution in regulatory and sub-regulatory guidance to define, and refine, the concept of hospital inpatient status. The Social Security Act upon which the Medicare program is founded defines hospital inpatient services, but left the distinctions among inpatient, outpatient, and observation statuses to the regulatory authority of the Department of Health and Human Services (HHS). Patient status as inpatient, outpatient, or observation impacts the level of care received and has financial implications to the health care facility and the patient.
